Enforcement Bulletin: Regarding Home Delivery of Adult Use Cannabis from the Washington State Liquor and Cannabis Board (WSLCB)

The WSLCB released the following enforcement bulletin regarding the home delivery of adult use cannabis today

Marijuana Retailer Licensees

Bulletin No 20-01

Date:               February 26, 2020

To:                  Cannabis Industry Members

From:             Matt McCallum, LCB Advertising Coordinator

Subject:         Home Delivery of Marijuana Is Not Legal At This Time

This bulletin is a clarification and reminder to all marijuana licensees that delivery of cannabis from retail licensed locations to customers outside of the licensed premises is prohibited. Some companies claim to have found a way around the delivery prohibition, but to date there is no legal method for commercial delivery of cannabis from a retailer to consumer off premises.

RCW 69.50.4013 (4) (a) states: The delivery by a person twenty-one years of age or older to one or more persons twenty-one years of age or older, during a single twenty-four hour period, for noncommercial purposes and not conditioned upon or done in connection with the provision or receipt of financial consideration, of any of the following marijuana products, is not a violation of this section, this chapter, or any other provisions of Washington state law:

Q:        What does this mean for licensees?

A:       Retail licensees cannot participate in home delivery, home delivery services, or  apps for home delivery that violate any of the two stipulations above. If approached with proposals claiming to allow for legal home delivery, please contact your enforcement officer.

Q:        Are there any exceptions?

A:        The RCW above is a written exception, but it does not allow for retail licensees to participate in delivery of cannabis.  The exception is specifically for non-commercial, and non-financial purposes. It does not exempt licensees from their prohibition on home delivery, and there is no legal pathway for commercial delivery, delivery service, or a delivery app to be used to facilitate home delivery from retail licensed locations to customers.

If you have any questions, please contact your area LCB enforcement officer.
